Franklin. Franklin is the name of the man who will abuse Matt – *Matthew*, Foggy decides, because that is nowwhere near as repulsive and horrible and wrong as the idea of Foggy mistreating Matt.

„Hi. What can I get you boys?“
„A beer. And make it quick if you want a tip,“ Foggy says, not even looking at her, tone terse and loud enough for anyone passing by to hear him.
„Right. Coming right up,“ the waitress jots his order down, utterly unperturbed, probably used to horrible customers. „And for you...?“ She turns to Matt.
„Um, can I also have a be-?“
„*He* will have a glass of tap water. Getting fat enough as he is,“ Foggy interrupts him. Matt catches the slight hesitation of the woman and privately suspects she's currently looking at Foggy like the man was either insane or whether *he* was the blind one of the two. In his current role, though, all he does is shrink into himself a little further and mumble a small,
„Oh. I thought maybe one beer would be okay? You said-“
„*Matthew*,“ Foggy says eerily calmly, „Do we have to talk about this again?“ He gives the waitress what sounds like a sort of smile in his voice. „He keeps forgetting he's on a diet. Just a water for him, please.“
„Uhm...“ the woman still hesitates, moving her head like she's probably casting an insecure glance at Matt, so to rescue her from her predicament, Matt finally raises his own head and gives her a brittle smile of his own. „He's right, actually. Just a water for me, please.“
„...okay. Coming right up,“ she repeats herself, though her earlier cheerful demeanour seems gone now and she disappears from their table quickly. Matt sighs.
„You're depriving me from alcohol for this thing. Not fair,“ he mumbles.
„Hey, I have the harder job in this. I want to make sure you're as miserable as me,“ Foggy replies easily, voice even quieter, knowing that Matt would be able to hear it anyway. „Picking anything up yet?“
„Well, the waitress is currently telling her colleague all about us and her personal choice opinion of you,“ Matt says, then winces. „She does have an...extensive vocabulary.“

„Do you think...?“ he whispers back, using his elbow to keep Matt somewhat closer to him, whether to make their charade look more realistic or whether he's ever so keenly aware now that there may or may not be an insane person behind them intent on *murdering* him and Matt is his only chance of that not happening, he isn't so sure any more.
„It...could be. Probably.“ Matt doesn't resist the tighter grip. „His heartbeat is...slower than normal, but it's been getting faster since he started walking after us.“
„So it's definitely a guy?“ Foggy asks, talking more in attempt to keep himself from panicking than actual curiosity.
Matt cocks his head for a moment. „Yes,“ he says. „He sounds about...six foot two and 200 pounds. Broad shoulders. Walks like an experienced fighter.“
„Brilliant,“ says Foggy, and thinks that he should have kept his mouth shut.
„Only one way to find out if it's the guy we're looking for,“ Matt says. „Shove me.“
„Ugh. Really?“
„*Yes*,“ Matt hisses, and so Foggy does.
„Will you stop being so *clingy*?!“ he barks and pushes, hard. Muscle coils under Foggy's hand and for a moment he is very keenly aware of the power difference between them, how this man called Daredevil could wipe the floor with him in all but a second if he wanted to – but then he's just *Matt* again, suddenly so soft and *trusting* underneath Foggy's hand, that it takes all Foggy has to not catch him when he shoves him into the wall.
„Ow!“ Matt gasps in a tone that could - almost – be convincing if Foggy didn't know what kind of injuries his partner usually sustained, and when he turns his face in Foggy's direction again, his expression is so frightened and hurt that Foggy for a moment feels like the biggest piece of scum in the universe. „F-Franklin, I'm sorry, I didn't mean to-“
Franklin. Somehow, Matt calling him by the other name makes this entire thing easier to bear. Foggy grits his teeth and grabs for Matt's arm again, yanking him rudely back to his side.
„Save it. Just try to walk like a *normal* person for once and we wouldn't have this trouble,“ he grumbles, just a tad louder than he would normally, in case the guy catching up with them from behind was close enough to catch it. The street lights in Hell's Kitchen are shit; he was only able to get the impression of a vague shape – tall, broad, male, confident stride like Matt had said, but nothing else. At Foggy's side, Matt catches his balance much more gingerly than he usually does, his cane skittering unsteadily over the broken sidewalk in front of him, and then Foggy is already hauling him off at his elbow again, his stomach boiling with hate at the thought that someone would do that to an actually blind, non-super-senses-enhanced person. Or, scratch that, do that to *anyone*, period.
Matt, however, seems to feel no such internal dilemma. As Foggy shoots a sideways glance at him, his mouth is actually twisted in a grin.
„Gotcha,“ Matt whispers. „It's our guy. Heartbeat spiked right as you shoved me. And he's picked up his stride.“
„Great,“ Foggy swallows. „So now what-?“
„Turn into that alley over there,“ Matt gives a subtle indication with his head. „As long as I'm not wearing the mask I'm not planning to take him down in the main street.“
„No. Of course not,“ Foggy says resignedly, because this is his life now, and then turns into the dinghy, dark and damp side alley Matt had indicated.
As soon as they're around the corner, Matt has already disentangled himself from Foggy's arm and thrown his cane into the nearest corner.
„Stay here. Don't move. I'll be just out of sight-“
„What? Wait-!“ Foggy starts to protest, but then Matt has already clambered up the fire escape to the side, pulling out of his pants pocket what seems to be the mask of the suit, with one hand somehow managing to open up and throw away his shirt, beneath which the top of his body armour becomes visible – dear god he has to have been *hot* at the club, flashes through Foggy's mind, a bit disconnected from current events it seems - and now it also suddenly makes sense that Matt had put on his old black vigilante pants for their outing, beneath which is probably the rest of the suit and which now lets him effortlessly blend into the shadows of the building as he crouches, waiting for their prey.
Their prey, whose footsteps even Foggy can now hear. His own heart hammering in his chest, he turns to the mouth of the alley, frozen like a paraplegic deer in the headlights as the killer appears -
And then Foggy sees the face of the person who has been following them.
„Matt NO!“
Their follower blinks, surprised, and that is all the warning Captain America gets before the literal devil jumps on top of his head.

And yes Foggy, I agree with you, the idea of anyone treating someone who hadn't consented to that sort of thing like that is horrible.

„Ma – DD! STOP!“ Foggy yells again, and this time, Matt actually listens – tilts his head, pulled-back fist frozen instead of hitting CAPTAIN AMERICA into the face, and then there's a flurry of movement from the floored Avenger, and Foggy thinks what he sees is Matt barely bringing up his other forearm in defense when a powerful swing of the Captain's arm dislodges him and sends him tumbling onto the alley floor in a heap.
„What the *hell* is going on?“ Captain America has sat up, and, thankfully, looks more utterly confused than in avenging-mode right now.
„Uh...“ Foggy mostly stares, because his hero-worship shows up at the most inconvenient times, but fortunately, Cap then turns his head to watch as Matt rolls back to his feet again. The Avenger's eyes narrow.
„*Daredevil*?“
„Um,“ Matt replies, sheepishly. „Yes?“
„Why...“ Captain America starts, then stops, again looks at both of them and finally just settles for simply „*Why*?“ again. It seems like it's actually the most sensible question.
„Wait, you know Captain America?“ Foggy asks in wonder, and Matt shoots him what would probably be a 'So-NOT-the-time-for-this-Foggy' expression if his face weren't covered by the mask. He turns back to the Captain.
„Me and my...friend...were trying to attract the serial killer targeting perpetrators of domestic violence,“ he explains. „Seems like we alerted you by mistake. Sorry.“ Cap meanwhile has stood up and now looks at them, utterly confused. Foggy would like to be swallowed up by the floor right now.
„Wait...“ Gears seem to be turning in the Avenger’s mind as he turns his head toward Matt in the mask. „The one playing his partner just now? That was *you*?“
„Yeah.“ Matt shrugs, obviously uncomfortable at the fact that someone other than Foggy has seen him unmasked while he was technically on Daredevil business. Foggy guesses they can only hope that it had been too dark for Cap to make out any specifics.
The Avenger gives them a look. “So you’ve decided that the *obviously best way* to catch a serial killer is to involve a *civilian* and…pretend to be *married* to him?”
“The ~Avengers~ are welcome to help out and find a more effective method.” Matt amazingly manages to reply without actually separating his teeth. “And if you could manage it *without* destroying half of Hell’s Kitchen this time, we would be absolutely delighted.”
“Hey. There’s no need for sarcasm,” Captain America gives them a mild frown, but, interestingly, also seems to look a little guilty at Matt’s reminder.
“Sorry,” Foggy says in Matt’s place. “It’s kinda been a long night.”
“I’ll say. It’s been a while since someone managed to get the drop on me,” Cap says, now actually letting his lips twitch into a brief, tired smile (while Foggy tries to ignore Matt who seems to have difficulty not to preen). “There’s nothing I could say to make you stop what you’re doing, is there?”
“Not really, no. Sorry,” Foggy says again, because there’s simply something about an unhappy-looking Captain America that makes you want to say ‘sorry’ a lot.
„...right.“ The Avenger frowns again, but then nods. „Well. Guess in that case I needn't have worried.“
„It's good that you do,“ Foggy says what he's pretty sure is Matt also thinking.
„Right.“ Captain America says again, still not looking happy, but also like he doesn’t know what else to say to that. „Do you…need any help with this?“ he asks a bit awkwardly.
„We've got it covered. But thanks for the offer,“ Matt says, earnestly, but then cocks his head when it still seems like Cap has something that he wants to say, but doesn't quite know how to. „Anything else?“
„Nothing, really. Only...“ the Avenger rubs the back of his head, for a moment looking like he has a toothache. „It's just...I get why you do what you do, only...don't you think, playing blind for that role...“ he gestures at the discarded cane and sunglasses on the ground and frowns.
„Don't you think that's a bit...insensitive?“

„INSENSITIVE!“ Matt is still sounding highly offended, even though it's been more than two hours since they came back. Foggy isn't quite sure yet what his feelings on the matter are, suspects that it’s mostly the adrenaline talking, but for now he's still leaning toward 'highly amused'.
„Oh, come on. You have to credit him for originality. Bet you haven't heard that line before.“
Matt snorts but otherwise doesn't deign to answer.
„So you know the Avengers but they don't know who you are or that you're blind,“ Foggy says, pulling out two beers, because ~Captain Fucking America~, and this needs a toast.
„Well, I'm not sure I'd call it knowing them. Or all of them. I've run into two or three of the bunch a couple of times. Sadly, never Black Widow.“ He gives a little frown.
„Dangerous, beautiful woman with questionable character. You two would be dating in under two minutes,“ Foggy mumbles under his breath and places the beer in front of Matt. Matt takes it and takes a swig.
„Eh, I don't know. I think I may have had enough of that particular type for a while.“
“Oh?” Foggy asks, and hates his voice because it apparently had decided that they should be going for the ‘hamster’ pitch right now. “Is that so?” he manages to add, tone thankfully lower this time.
“Mmh,” Matt says, thoughtfully. Curiously, he also seems more interested in his beer bottle right now, unfocused stare directed onto his hands rather than at Foggy’s face like he usually does. “I think...by now I may prefer…” then he abruptly clears his throat, though, and gives Foggy a smile that seems a bit forced. “…a partner who keeps roughing me up, apparently?”
“Uh-huh,” Foggy replies, unimpressed. “In that case, Murdock, scoot over on that couch or I’ll add to that bruise the Captain gave you,” he says, and, just to add to the mock performance, taps a finger carefully just below the mottled skin on Matt’s cheekbone where the Avenger hit him to throw him off. Matt doesn’t flinch at the contact, must have sensed it coming, and, interestingly, even seems to like the touch skirting just around his injury, because he tilts his head ever so slightly into it.
“That a promise?” he asks Foggy with a grin.
At which point Foggy actually shoves Matt for real, and the ‘Devil of Hell’s Kitchen’ as well as ‘Matt Murdock, abuse victim’ ends up laughing on his back on Foggy’s couch for the next few minutes, trying to vainly protest being bunched into a corner by said owner of the couch, and Foggy can’t help but wish for a moment that this – him manhandling a laughing, sputtering Matt, pretending to hold him down (as if he could) and making ever more absurd threats of various punishments – wasn’t just a silly extension of Daredevil theatrics, and instead something just for them, but…*well*.
A man can dream, Foggy thinks, as he watches Matt fake-beg underneath him to be let go.
“I promise to not hog the couch any more. Mercy? Also, you actually probably need to let me up, because if I don’t get back to my place soon, neither of us is going to be awake at the office tomorrow.”
“…bossy. Some fine DV victim you are,” Foggy jokes, because joking is his way of coping with *that* imagined horrible scenario, but then moves off and allows Matt to upright himself again.
“Sorry.” Matt grins unabashedly. “I’ll try to be more meek and cowed when my ‘abusive partner’ stops making me laugh at stake-outs.”
“Promises, promises,” Foggy says as he holds the door open for Matt to leave, then sighs when he closes it again after he can hear Matt’s steps descend the stairs.
He *really* hopes that Matt’s super senses did *not* extend to detecting how much of his blood was suddenly rushing south at the sight of him underneath Foggy, but doesn’t hold out much hope, because his life simply doesn’t work that way.
Oh well, Foggy thinks. He didn’t get murdered tonight and Matt only got hit once, so he’ll take what little victories he can get.

„I brought you donuts. The super-boring plain kind that you like so much.“ Foggy shifts. „You probably knew that, right? Super-freaky smell powers and everything.“
„I knew you brought donuts,“ Matt confirms with a mild smile, „Didn't know you brought them for me, though – my super-freaky smell powers let me down on that.“
„Yeah, thank god they don't extend to actual mind-reading,“ Foggy says, stepping into the office and putting the box with pastries down at the edge of Matt's desk. „Happy breakfast.“
„Thanks,“ Matt says, actually genuinely hungry and gladly taking one, before leaning back and raising an eye brow into Foggy's general direction. „So, any ulterior motives that prompted this, or...?“
„What? No!“ Foggy exclaims, going for a mock-shocked tone. „What do you take me for, Mr. Murdock? This is purely out of the goodness of my heart.“
„Hm-mmh,“ Matt humms through a mouth full of donut, pretty sure he's getting sugar on his papers. Sometimes just waiting with Foggy is enough.
„Well, um, actually...“
Matt suppresses a smile.
„...I felt like I needed to get you something because I've been verbally abusing you for what felt like two hours yesterday.“
Matt's smile vanishes. „What? Foggy, we were *play-acting*. I know you didn't mean those things you said!“
„I know,“ Foggy protests (though his heart-rate slows just slightly, so he apparently has been on edge about this). „It just...didn't make it feel any less shitty.“
Matt can feel his jaw harden a little – this was one thing he hadn't foreseen. He had wanted Foggy as far away from the whole Daredevil thing as possible, and now what he had feared is already happening – he's dragging Foggy down with him, tainting him, making him as miserable as he sometimes feels.
„Foggy,“ he sighs. „Maybe we should stop this, this was a terrible idea from the start-“
„What, the horns? I told you about those.“
„Foggy.“
„No, Matt, we're not stopping,“ Foggy says and now his voice sounds surprisingly calm again, and honest.
„But-“
„No. Matt, I know you. If we stopped this now, you would probably go out and find yourself an *actual* abuser to lure that killer in. God knows you manage to attract the shady types.“
Matt wants to protest at this, but finds himself hesitating. Fact is, he actually *could* be tempted to try something as crazy as that if he became desperate.
„Yeah, see, I do know you,“ Foggy says triumphantly and Matt can hear his muscles stretch into a smile. „C'mon on, man.“ He leans over the desk and claps Matt on the shoulder, a friendly, familiar touch, so different from the stiff, pretend-rough way Foggy handled him last night.
Matt knows he probably shouldn't enjoy either of them as much.
„You know, you say you don't like it when people treat you like you're made of glass,“ Foggy leans back again, „So do me the favour and don't treat me like that either, okay? I can handle it.“
Matt blinks. Put like that, Foggy does kind of have a point. He purses his lips.
„...okay.“ he ventures at last.
„See? That wasn't so hard, was it?“ Foggy's smile is audible in his voice. „You just gotta let me buy you donuts the day after and everything's fine, I promise.“
Matt laughs.
