So, ummm... I decided to continue with this anyway? I'm 90% certain it was me, because the title is one of my favourite songs and I think I remember using it. ^.^;

It was a week before Foggy saw the Devil again, so it shouldn't have been a surprise when he was relaxing at home with a non-alcoholic (what, he did listen sometimes, okay?) beverage when he heard a whispered "have you found anything interesting?" hot and musky in his ear.

Foggy would like to deny that he jumped from his seat, spilling his drink all over his shitty worn out couch in the process.

"Dude!" He yelped, twisting around only to be greeted by the most smug smile he had been party to in a long while. He glared at his unwelcome guest. "This is my home. Not cool, okay? I am not okay with this!"

The irritation in his tone must have made the Devil pause, because the asshole had the gaul to look sheepish, flashing a winning smile and giving a small shrug of his shoulders.

"I'll knock next time?" The vigilante offered, even though Foggy knew it was a complete lie.

"Stupid fucking charming devils, I swear to God..." Foggy muttered under his breath in a voice quiet enough that the Devil shouldn't have been able to hear.

However, it wasn't so much the fact the Devil heard him that had him freezing up, it was what he responded with.

"Language." The masked man chided, before he'd seemed to realise he'd done it.

Foggy's entire body went stiff, his heart ratcheting in his chest as his thoughts turned back a couple of years, to that words whispered playfully as two students where on their way to black out drunk, of Foggy forgetting he shouldn't blaspheme in front of his adorably Catholic roommate, of the times he did it on purpose in the throes if cramming for an exam just to hear that beautiful tenor, something he never told his roommate that had given him the drive to carry on the hardships that were law school exams. On the bad nights, the nights he had wanted to quit, he'd whisper cuss words on the guise of stubbing his toe, just to hear the amused whisper answer back.

"Foggy..?" He heard the tentative voice, and it took him a moment to remember where he was, who he was with, or rather who he wasn't with.

'You're the one of left him.' A bitter part of his mind supplied, and his heart clenched painfully thinking of the day Matt frame to him, shaky but determined, and asked Foggy to leave with him.

The day Foggy rejected the love of his life, because he was too chicken shit to confess, and too in love with Matt to bear following him.

"Sorry, man," Foggy says, trying to shake away the melancholy thoughts before they consumed him. "I just used to have this... Friend, he said the same thing."

He wished he didn't sound so damn choked up, watching the man in black nod solemnly, all his easy going charm filtering away.

"You were close to him." It was a statement, not a question, and if Foggy hadn't been so distraught he may have noticed the gravelly hero voice of the man in front of him waver.

As it was, he didn't.

"Yeah." He breathed. "Yeah I really was."

yay, a continuation! i love matt just casually breaking into foggy's apartment because he has no sense of personal boundaries where foggy is concerned, and then foggy connecting the devil to matt without, of course, actually connecting them, because obviously a blind lawyer isn't going to be a vigilante nor would matt still have any interest in foggy after the way foggy abandoned him. *pets them both*

It continued on for weeks, turning to months. Daredevil would infiltrate his apartment, casually, scare him half to death, then leave as Foggy has falling half to sleep.

Sometimes it was for business, sometimes it wasn't.

It became an easy routine, the banter between him and the Devil. It was almost enough to make him forget about the gaping hole in his heart where Matt used to be, on the better days.

But as hard as Foggy tried to ignore his feelings, life had always been a cruel son of a bitch to one Franklin Nelson.

"Nelson!" Generic grunt intern no#5 called him, standing over his desk impatiently.

"Yeah?" He answered back, not even pretending like he knew the baby shark's name.

A snarl took over the intern's face, and he sneered "the boss wants you." Before flouncing off, presumably to go lick someone's boots.

Sighing, Foggy fiddled with his and Matt's old plastic dinosaur set, still set along the divider between what was their desks, which now belonged to him and generic grunt intern no#1. The guy wasn't amused by them, not like Matty was.

"Nelson!" He heard the boss screech as he was running his hand over the little pink dinosaur, making him jerk and have to grab the little plastic toy before it fell onto his deskmate's territory.

He pocketed it, promising the toy he'd balance it back on the top with it's brethren once he was done talking to his supervisor.

"You yelled, boss?" Foggy said casually, as he walked into his swanky corner office near his broom closet cubicle.

His supervisor was a cranky old man, a lawyer who had seen too many things and won too many battles for the wrong team that he didn't seem all that attractive anymore. Too many wrinkles, too many stress lines. His cocksure attitude had been beaten down, moulded into an angered hatred of the world and everything in it.

Foggy didn't want to be like that.

"You have a case, Nelson. With Miss Stahl. Report to her immediately." Marci had obviously been working her magic for him, again. Well, that was nice, at least. Foggy just kind of hoped it wasn't for the same reasons as last time, because he was so not ready to re-open whatever it was they had when his heart still felt like it was in Matt's hands.

The thing about Marci was that she was a damn good lawyer. She had a tenacity about her that was rivalled by very few people in the firm, and it was obvious to anyone she was on a fast track to be partner, if the fact she went from intern to attorney in the matter of weeks.

But the other thing about Marci was she wasn't above using people to get what she wanted. She knew people's pressure points, and took advantage of them with a sense of ruthlessness.

When Foggy got to Marci's desk, he was informed she was already in the midst of a deposition, one that he was late to, apparently.

Steeling himself, he wandered to the office that the receptionist (he gave himself a moment to think hysterically 'as if Marci had a receptionist!') had directed him to, before entering the room.

The sight before him knocked all the breath out of him, he was pretty certain his heart stopped.

"Ah Matthew," Marci purred, her smug voice filtering through the otherwise silent air. "You remember my associate, right? Come in, Foggy Bear."

Because of course sat in stiff surprise opposite Marci, was none other than Matthew bloody Murdock.

Foggy was going to kill Marci. Yup.

Matt was still a breathtaking kind of beautiful, which was just unfair. Since Foggy had last seen him, he'd lost a fair amount of weight ('not eating properly', his mind supplied vindictively, 'it was always me who made sure he did') and he looked so much more exhausted than he used to.

The easy sort of playful charm that usually rolled off of Matt was washed away, replaced by a tidal wave of shock, fear. It made Foggy visibly cringe- not that Matt could see that.

Foggy, however, did not miss the way Mat flinched when Marci said his own name. As though Foggy's presence had slapped him in the face.

Marci definitely knew how to twist the knife, and it looked like this one was aimed for both their hearts.

"Foggy..." Matt whispered, voice small and reverent. Like he was a sight to behold (metaphorically), like he wasn't the one who'd abandoned Matt.

Drawing in a shaking breath, trying to calm himself, Foggy did the one thing that he could to protect himself, his heart.

"Mr. Murdock." He spoke, as professional as he could manage. He held out his hand, informing Matt that he was doing so. Act professional, it's less painful this way.

He wasn't prepared for how shattered Matt looked hearing that. He stood and shook Foggy's hand, before finally reigning himself in and closing off his features, completely.

"Mr. Nelson." He nodded, sitting himself back down and turning to Marci, letting her begin.

This was way harder than Foggy thought it would be. Seeing Matt sitting there made him just want to reach out and comfort him, protect him from Marci and force him to eat a good meal. All the things Foggy couldn't do anymore, things that he couldn't have done all those months ago without confessing to his straight best friend.

And Marci was ruthless, ripping into Matt with abandon. It was more like an interrogation than a deposition, words flying between the two lawyers like rapid fire and escalating, neither party's clients able to get a word in edgewise.

It was becoming far too heated, veering away from professional when Marci finally turned to him and hissed 'Foggy!'

Foggy started, but offered. "Anything the opposing counsel brings to the table presently is hearsay. This is a deposition, not a trial, and it would do you all good to realise that. This is about our client's trying to find a reasonable agreement and settle, before taking this to trial. Not only is Mr. Murdock badgering the client, we could build a strong case for harassment if he continues, need I remind everyone this is all being filmed."

He gestured to the camera, biting his tongue to stop himself to narrating the action to Matt. He couldn't show he cared, couldn't give any indication Matt still held power over his actions, and it was killing him.

The entire room was silent for a few moments, a little stunned by the outburst, before Marci spoke once again, "Will that be all, Mr. Murdock? If so, we'll see you in court."

Foggy nodded to Marci, standing and fleeing the room without ever looking at Matt.

That night, when Foggy got home, he drank anything he could find in his apartment, which turned out to be a beer and a half bottle of vodka.

The alcohol didn't make him feel better at all, only really managed to give him a weird numb feeling in his throat that lasted while he downed the vodka.

He sat on his sofa, his hands tugging at his tangled mess of hair.

"Fuck.." He breathed, laughing to himself at what a complete mess he was. One little meeting and he was a wreck, what was he supposed to do when this shit went to trial?

He wallowed in self pity a few moments more, before dragging himself to the window he kept open in case any wayward vigilantes wanted to pop by.

Taking a deep breath and not giving himself enough time to chicken out, he belted a loud, "Devil!" into the cool night air.

The sounds of the city were all that answered him, the hum of people and cars and filth. He grit his teeth, "Come on you ass!! You show up every other night the least you could do is turn up when I need you!"

No answer, not that he was really expecting it to work. The Devil had said he had advanced hearing, but why would anyone be listening to Foggy?

Across town, the Devil of Hell's Kitchen sat in the midst of his wrecked apartment, listening to his best friend's calls and fighting back tears.

The day Matt left Landman and Zack was simultaneously one of the best and worst days. He finally felt free, a shaky sort of confidence filling him as he handed in his resignation.

His heart was soaring, his footsteps felt light and as he headed to his and Foggy's office Matt felt a bravado he hadn't felt since the first night he put on the mask. It felt right to ask Foggy to join him, excitement bubbling in his chest as he thought of the future. Nelson and Murdock... The thought brought a bright grin to his face, even if he still felt fearful. If he was with Foggy, he could do anything.

His world came crumbling down around him he moment Foggy paused, hesitated, said no to joining him. He'd begged, pleaded with Foggy, put his heart on the line because he couldn't do this without his partner...

Foggy still rejected him and it felt like his heart had been ripped from him, still beating and connected, the arteries pulling and straining as he walked away, trying to pull him back to Foggy.

He'd gone home and broke down. He felt like he was drowning, desperately treading water as the currents grew stronger and angrier.

That night, as he let the silent tears fall, was the first night he couldn't bear to listen to the cries of the other tortured souls of Hell's Kitchen.

He would cry, and feel the anguish of losing something precious, but he would make sure that the girl down the street would never have to again.

The first mask was fashioned from an old sweater he had stolen from Foggy in tier first year ('why the hell do you want it, Matty, it's so boring and black!') to remind him of what he was fighting for.

He tore it with care, fashioning it into a passable mask and storing away the off-cuts.

Matt sighed as he slipped it on, Foggy's scent permeating the fabric and calming his frayed nerves. He could do this, he told himself, he could unleash the devil within him and use it for good.

That night, bruised from where the bastard had got a few good hits in, he felt the way he had at Landman and Zack. Free, lighter than air, but grounded by a sense of justice, the rightness of his actions a comforting weight on his shoulders.

He drank to his victory, and it wasn't until he was more than a little tipsy (a place that he never really got to without Foggy egging him on) that he pulled off the mask, bringing it up and cradling it to his chest.

Through the smell of sweat and the city, he could still smell Foggy. It smelt like home, and Matt let himself want.

He knew it was pathetic to pine for Foggy, but he'd been doing it for too long that he couldn't really help it. The other man had a way of breaking down all of Matt's shields, stripping away the barriers and exposing the scared little blind boy underneath all his cocky attitude and fronting.

He knew he was in love with Foggy, had been a long while. But he was scared, his heart always cautious. He had loved his father, and Stick to a certain extent... Yet here he was, alone. He hadn't wanted to lose Foggy too. He'd his his feelings away, because he didn't know if he'd be able to stand it if that happened, and now look where he was, where Foggy was.

Too late.

oh, matt, you poor soul. *pets him gently*

(question: you say in the second paragraph that "Matt felt a bravado he hadn't felt since the first night he put on the mask," but then later you say that he puts on a mask for the first time after foggy refuses to leave L&Z with him, and that pain makes him unable to keep shutting out other people's pain. so had he been daredevil before that moment or not?)

This... Is why I don't write really early in the mornings. ^.^;; to answer truthfully I sort of changed my mind half way through writing matts pic about a lot of things in the story so we'll go with ignore the first part? I can't really proof read much on mobile it's a real struggle. DX sorry!! x
