from what i recall, it takes a few weeks just for the prosecutor to decide if they want to prosecute you for your crimes
about a month or two from an arrest you'll get an arraignment which is when you plead guilty or not guilty to the charges you are indicted for.
from what i've read, misdemeanor processes take around three months, while felonies are around six months to a year. remember, the boston bomber committed his terrorist acts in april of 2013 and only got sentenced a couple months ago. if you're talking a class D felony i'm assuming you mean robbery, so maybe go for a year or so for the entire process?
Re: How long does a class D felony trial actually last?
Oh wow, that's quite a long time. Though I'm surprised you say it takes a month or two until an arraignment. There was an article I read that says it has to happen within six days of the arrest. Or maybe that's just the first one, and there's a second one afterwards. It must admit I didn't read it that closely cause I started going crosseyed from all the legal information. :-P Thanks for the info, though! I'll try to work with that.
And the felony is a larger scale fraud, not robbery. Or is that not a class D felony? Though I don't think it matters much because I'm not going to go into a lot of detail on that. I just wanted to get an idea of how long a prison sentence was realistic for that type of crime.
Re: How long does a class D felony trial actually last?
It can take years to get to trial, particularly in New York, where there are massive case backlogs. 1500 inmates at Riker's have been incarcerated for over a year without having been convicted of a crime. 400 of those have been there over two years. A young man (Kalief Browder) recently committed suicide two years after being released, having been held for over three years, most of it in solitary, before his robbery charges were dismissed.
Re: How long does a class D felony trial actually last?
AYRT Realistically, the third episode of the show would've taken place over 1-3 years. Even if Fisk pulled strings to speed things up to an unrealistic degree, it would've taken 6-8 months. On the actual show it was probably a couple of weeks (Matt had time to heal up all the way, but Claire is still cat-sitting in the next ep). So, I think you can argue that the MCU canonically has a speedier criminal justice system.
